When should a company consult the Robinson List?

In accordance with the provisions of Article 23.4 LOPDGDD, whenever you are going to carry out advertising campaigns to recipients from whom you have not obtained consent in accordance with the provisions of Article 4.11 of Regulation (EU) 2016/679 for the sending of your advertising communications.

If you have a Call Center or you are going to make commercial calls in your company, you are obliged by law to filter by Robinson List.

How should Call Centers and companies use the Robinson List?

We all agree that telemarketing is a very effective work tool for all companies, but we must be sure that we comply with the current law, to avoid economic sanctions that could jeopardize our entire company.

Due to the high volume of calls made today by companies contacting customers or potential customers to offer their services, the public administration has taken measures to bring order and protect the consumer.

One of these measures has been the implementation of the Robinson List, in which citizens can now sign up for free and certify that they do not wish to receive commercial calls of any kind or from any company.

How should Call Centers use the Robinson List?

Companies and call centers that make calls on a daily basis are required by law to be aware of the Robinson List service and may not contact users who are registered on it.

What happens if my company makes calls without using Neotel’s Robinson List service and, therefore, I cannot be sure that in the calls I am going to make, none of the recipient numbers are registered in the Robinson List?

Well, any user and/or citizen can report it to the Spanish Data Protection Agency (AEPD), which would result in serious financial penalties for the company.

Throughout 2021, without going any further, there have already been several Spanish companies that have been seriously sanctioned for failing to comply with the current law regarding skipping the Robinson List and not filtering their commercial calls before making them.

Why should I consult this list?

According to the Data Protection Law, those who intend to carry out processing related to advertising or commercial prospecting activities must consult the common files that could directly affect their actions. The aim is to prevent the data of data subjects who have expressed their opposition or refusal to such processing from being processed.

In other words, it is necessary to consult this list in order to carry out data processing, since you must exclude data subjects included in the Robinson List file from your advertising campaigns.
